Exempted entities

The ReFuelEU Aviation Regulation is mandatory for all aviation fuel suppliers, aircraft operators, and airports designated as “Union airports” within the European Union. It sets legally binding targets for the gradual incorporation of SAF into aviation fuel supply.

The regulation requires all affected entities to:

Supply or use aviation fuel with a minimum proportion of SAF, beginning at 2% in 2025 and rising to 70% by 2050.

Report annually on fuel volumes, SAF blends, and emissions performance.

Ensure that aircraft operators refuel sufficiently at EU airports to avoid carbon leakage from fuel tankering practices.

Exceptions and Flexibility

While mandatory, the regulation provides defined flexibilities:

Aircraft operators conducting fewer than 500 passenger flights or 52 all-cargo flights per year from EU airports may fall outside the mandatory scope.

Certain outermost region airports are excluded from SAF blending obligations due to logistical constraints.

Between 2025 and 2034, Member States may apply aggregated compliance mechanisms, allowing flexibility across multiple airports within the same national system.

Important Deadlines

  • 1 January 2025: Start of obligations; at least 2% of aviation fuel supplied at EU airports must be SAF.

  • 2030: The minimum SAF share increases, including specific subtargets for synthetic aviation fuels.

  • 2050: At least 70% of aviation fuel supplied at EU airports must be SAF, with approximately 35% as synthetic aviation fuels.

  • 31 March each year (from 2025): Aircraft operators must submit annual verified reports on fuel uplift and SAF usage.

These milestones are designed to ensure a progressive shift toward cleaner aviation fuel and align the sector with the EU’s net-zero objectives.

Current Status

ReFuelEU Aviation is fully adopted and in force across the European Union. The regulation was approved in 2023 as part of the Fit for 55 package, the EU’s broader climate policy framework. The main compliance phase begins in 2025, when SAF blending and reporting obligations become mandatory. Airlines, fuel suppliers, and airports are preparing to implement monitoring and verification systems, while Member States are setting up national enforcement mechanisms. The regulation plays a central role in reducing aviation emissions, stimulating the SAF market, and supporting the EU’s target of climate neutrality by 2050.

Penalties for Non-Compliance

Each EU Member State must establish effective, proportionate, and dissuasive penalties for non-compliance. These may include administrative fines for failing to meet blending or reporting obligations, temporary restrictions on fuel supply, or the revocation of operating authorizations in severe cases. The European Commission oversees compliance reporting to ensure consistent implementation across Member States.

Examples of Known Violations

As of today, there are no public enforcement cases under the ReFuelEU Aviation Regulation, as the main obligations will apply from 2025 onward. Compliance monitoring and audits will begin once annual reports are submitted by fuel suppliers and aircraft operators.
